Next week we head into Richmond for trial on a first offense DUI
November 6, 2009 at 20:40 This coming week we are heading to Richmond for a first offense DUI case with a .18 alcohol level. We are exited about the opportunity to show the jury that our client was in fact not under the influence of alcohol or over a .08 alcohol level. The client feels strongly that she was in no way what they are claiming or she never would have driven her car. The good news is that we now have the Mcneal (holding that partition ratio is admissible against a generic dui charge) case on our side as well as my client's innocence.

Case update: Went to trial on the Richmond, CA DUI and we were able to get the Court to declare a mistrial. This good news because it puts us now in a better barganning position or in trial with prior transcripts that can be used to impeach the prosecutions witnesses. All in all, it was a job well done. We are now looking to resolve the Richmond DUI with a dry wreckless or retry the case. Matter was continued to February of 2010.
