San Rafael red light camera
November 7, 2009 at 22:16 So now the city of San Rafael has jumped into the business of giving red light camera tickets. These cases are prosecutions initiated by private companies, otherwise known as the vendors. What most cities fail to understand is that these prosecutions are a true shame to the criminal/constitutional field. The reason for this is that the person (vendor) who is providing all of the information for the prosecution of the offender also has a pecuniary interest in the outcome of the case. One question we often pose to courts about red light camera tickets is what would happen to the contract if suddenly there were no offenders? Who the private vendor then lose the contract? So even if there is no proof of malfeasance in the system, the fact that an interest occurs should be enough to say this hearsay prosecutions need to come to an end.

Many cities across the United States have reduced their yellow light durations after the installation of red light cameras. This has been documented to have occurred in Chattanooga, TN; Dallas, TX; Denver, CO; Springfield, MO; Nashville, TN; Union City, CA and most recently Chicago, IL. It has undoubtedly been implemented elsewhere as well.
