In an effort to reduce the number of domestic violance incidents, the government tends to be overreaching. In many instances innocent people get caught in the system, people who may simply be in need of private counseling as opposed to forced governement action. Yes we are not denying that there are many that need punishment, and forced counseling. The problem that we have is why should innocent people get sucked into the criminal funnel for the sake of reducing the number of incidents.

If you have been charged with domestic violence out of Marin, San Francisco, Alameda, San Mateo, Contra Costa Counties the you have come to the right place. Take a look at our informative domestic violance page here, or call us at (415) 378-4133, for a free consultation.

You were driving a car

At a speed that was unsafe for the conditions (at the time of the violation) or,

At a speed that endangered people or property (at the time of the violation)

One important fact is that you must understand is that VC 22350 has nothing to do with any speed limit. You can be in violation of VC 22350 by traveling at 25 M.P.H. in a 35 M.P.H. zone. Likewise, you can be traveling 55 M.P.H. in a 45 M.P.H. zone and not be in violation of VC 22350.

During most prosecutions of VC 22350 they (the Prosecutor/Cop) will forget to testify about why the speed was unsafe or attempt to present evidence that is not relevant to the violation because they were events that were observed after the violation.

The problem is that in the effort to reduce the "true speeders", many of the non-speeding drivers get caught in the net. This has become a recurring theme in many traffic violation areas.

If you have been arrested for a San Francisco DUI, a Marin DUI or an Oakland DUI, we can help! We have been successfully defending DUI's in the San Francisco Bay Area for a long time. The implications of a DUI conviction can be tremendous, both current and future. Call us today for assistance, (415) 378-4133.

*Remember that if you have been arrested for a San Francisco DUI, a Marin DUI, an Oakland DUI, Hayward DUI, a San Mateo DUI, or a DUI anywhere in California, you only have ten days from the date of your arrest to contact the DMV and request a hearing. If you fail to do this, your license will be suspended automatically!

San Francisco DUI cases for the holidays

The public should be aware that both the San Francisco Police and the San Francisco CHP will be out in numbers looking for San Francisco DUI drivers. The best defense to a San Francisco DUI case is to simply not drive if you have had ANYTHING to drink. You must remember that, when they have a zero tolerance in place, they will arrest anyone with the slightest smell of alcohol. The policy is to error on the side of arrest, rather then error on letting someone go. If you are driving in San Francisco and have consumed any alcohol, I high recommend that you spend $100.00 dollars on a cab, rather then $3000.00 to $5000.00 on a San Francisco DUI Attorney/Lawyer.

Barbara Miller, a former presiding judge of Alameda County Superior Court and member of the California Judicial Council, was found dead in her home Friday evening, according to the Oakland Tribune and San Francisco Chronicle.

Miller had been scheduled to receive an award from a women's law group Thursday night but told organizers she was too ill to attend, the Tribune reported.

Miller began her legal career in private practice, including six years at Thelen, Marrin, Johnson & Bridges, before serving a nine-year stint as an Alameda County court commissioner. She was elected to the superior court bench in 1996, beating out veteran prosecutor Richard Iglehart for the seat, and elected PJ by her colleagues for 2004 and '05.

In the last couple of years she gained notoriety for presiding over the UC-Berkeley tree sitters case.

Who the private vendor then lose the contract? So even if there is no proof of malfeasance in the system, the fact that an interest occurs should be enough to say this hearsay prosecutions need to come to an end.
